This Privacy Policy (“Policy”) governs Milford Helicopters Limited (herein referred to as “Milford Helicopters”, “we”, “our” and “us”) collection, use and disclosure of personal information. Personal information is information about an identifiable individual and includes any information whereby you may be identified or your identity can be reasonably ascertained (“Personal Information”).

Application of this Policy
This Policy applies to all Personal Information we collect about you when you engage or interact with us including when you make bookings for our scenic flights and experiences, send enquires to us whether through our website by e-mail or in person, visit our premise, use our website or use any other service that we may provide to you now or in the future (together, “Services”).
Where there are inconsistencies between this Policy and any of our other Terms and Conditions (such as a contract to provide you with a scenic flight) the terms of this Policy shall prevail in respect of our use and disclosure of any Personal Information collected.
Collection and Use of Personal Information
We collect Personal Information from you so that we can provide you with Services and for your health and safety during the provision of those Services. The Personal Information we collect may include your name, your weight (used for weight and balance calculations for the helicopters), contact details, next of kin and their details and your accommodation details. Where you provide Personal Information about another person such as your next of kin you warrant to us that you have provided that Personal Information with that persons consent. Additionally, unless we agree otherwise when we provide you a Service which is an experience (i.e a scenic flight) you consent to us taking and publishing photos and videos of you. Where possible we will collect your Personal Information directly from you, for example, when you submit Personal Information to us through our website, e-mail, phone, or in person whether you are making an enquiry, booking a Service or otherwise engaging with us.
When you visit our website we also collect Personal Information such as your IP address, operating system and browser of your device, general Wi-fi location, the date and time you visited our website, and what pages of our website you visited.
We may also collect your Personal Information from third parties as part of our recruitment process, when you use our website such as through cookies and monitoring software including Google analytics, or where you authorise collection from a third party, or that Personal Information is publicly available.
By engaging with our Services or otherwise interacting with us you agree that we and any third party authorised by this Policy may store and use your Personal Information to provide you with Services, respond to enquiries or complaints you have about the Services or us (including any third parties we may have contracted), to undertake any actions required by the law or regulatory bodies, administration purposes such as invoicing for our Services, conducting our recruitment process, safety and security and any other purpose we make known to you at the time of collection, and any purpose that you authorise the use of your Personal Information for.

Storage
Your Personal Information will be held at our premises located at Te Anau Airport or through our online database management system. We will take reasonable steps to ensure your Personal Information is safely and securely stored. The security of your Personal Information is important to us, however communications over the internet are not secure unless they have been encrypted. It is your responsibility to protect access to any emails or any other communications you receive from us. To the maximum extent permitted by law we disclaim all liability against any misuse, loss, unauthorised access, modification or disclosure of your Personal Information.
We will only hold your Personal Information for the duration it is required and the purposes for which it was collected or is otherwise authorised by the Privacy Act of this Policy. We will securely delete your Personal Information within a reasonable timeframe once it is no longer required.
Disclosure of Personal Information
By engaging with our services, you consent to us disclosing your Personal Information to our related company, Te Anau Helicopter Services Limited, third parties contracted to us to provide us with a particular service or to provide you with a Service on our behalf, our appointed payment providers, third parties we believe in good faith to which disclosure is required by law, and any other person you authorise disclosure to. Other than as set out in this Policy we will not disclose, sell or licence your Personal Information to any third party except as permitted under the Privacy Act or other relevant legislation and regulations. However, please note in accordance with Google’s Privacy Policy, Google may share Personal Information they have collected publicly with their Partners.
By purchasing a Service you consent to our payment providers processing Personal Information about you in the manner described in their privacy policies. We use Stripe for online payments and ANZ Bank New Zealand Limited through ANZ fast pay for in-person payments. Your Rights
You are entitled to request access to the Personal Information we hold about you and request that this is updated or corrected. We will disclose the Personal Information requested to the relevant person where it can be readily retrieved, unless there is a good reason in accordance with the Privacy Act for not doing so. Where you request a correction or update to your Personal Information, we will do where we think this is reasonable. If we do not update your Personal Information you can request us to attach a statement of correction for but not made, to the relevant Personal Information.
You have the right to complain if you feel we have not responded to your request or questions about your Personal Information. You also have the right to lodge a complaint with the New Zealand Office of the Privacy Commissioner.
